Barilla Australia Pty Ltd $5 Cash Back Promotion
1. Information on how to claim the $5 cash back offer ("Offer") forms part of these Terms & Conditions. By participating, Claimants agree to be bound by these Terms & Conditions. Entries must comply with these Terms & Conditions to be valid.
2. This promotion commences at 00:01 EST on 9 December 2008 and closes at 23:59 EST on 10 March 2009 ("Promotion Period"). This is a limited Offer open to the first 2,500 entries and the Offer is for a total $12,500.00.
3. Entry is open to all Australian residents 18 years or over. Employees of the Promoter and their immediate families, and authorised retailers of Barilla products, or distributors and resellers associated with this Promotion are ineligible to enter.
4. To enter, Claimants must during the Promotion Period:
a. purchase two products from the Barilla Pasta Sauce range from a participating store;
b. send the original two product barcodes to Barilla $5 Cash Back Offer at PO Box 739 Potts Point NSW 1335, together with the a legible photocopy of your receipt from store of purchase, including the Claimant's first and last name, address details, contact phone number and email address. (If the requested information is not provided you may not participate in this Offer).
c. Barilla products are to be purchased during the Promotion Period.

6. Entries must be received by the Promoter no later than 23:59 EST on 10 March 2009. Entries received after this date will not be accepted. No responsibility is accepted for late, lost or misdirected mail. If the Promoter has not entered into any correspondence with the Claimant prior to the last mail date of the Promotion, it is the responsibility of the Claimant to contact the Promoter to ensure their claim has been received.
7. Entries are limited to a maximum of one entry per household address per week of 2 Barilla Pasta Sauces. A maximum of one entry per household address applies. The Promoter reserves the right to requested proof of purchase in the form of an original receipt of the products purchased for all entries. Verification is at the Promoter's discretion, whose decision is final.
8. The Promoter assumes no responsibility for any failure to receive a claim or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may modify the promotion.
9. All valid entries received by 23:59 EST on 10 March 2009 will receive a $5.00 cheque awarded in the form of a crossed cheque made payable to the Claimant. It is the responsibility of the Claimant to advise the Promoter of their correct details for payment. Please allow 21 days for delivery of cheques. All taxes (including GST) that may be payable as a consequence of receiving the Offer is the sole responsibility of the Claimant.
10. Prizes are not transferable. The Promoter's decision is final and binding - no correspondence will be entered into. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if forged, manipulated or tampered with in any way.
11. If for any reason this Promotion is not capable of running as planned, the promoter reserves the right in its discretion to modify the terms of the Promotion including the Offer and these Terms & Conditions of entry.
12. The Promoter is not liable for any loss, damage or injury suffered or sustained (even if caused by negligence) as a result of accepting and/or using the prize, except for any liability that cannot be excluded by law.
13. Details from entries will be collected and used for the purposes of conducting this Promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion), for promotional purposes surrounding this promotion. By entering this Promotion, Claimants consent to the use of their information as described, and agrees that the Promoter may use this information in any media for future promotional purposes without any further reference or payment to the Claimant (including to promote and market the Promoter's products and services and/or those of its related entities, including by way of direct mail, email, telemarketing, SMS and MMS messages).
14. The Promoter is bound by the National Privacy Principles under the Privacy Act 1968. All personal information will be stored at the office of the Promoter.
15. Claimants may access, change and/or update their personal information and obtain a copy of the Promoter's privacy policy by contacting the Promoter as set out below.
